These Terms of Service ("Terms") govern your access to and use of the Custetch website, products, and services. By accessing our website or placing an order, you agree to be bound by these Terms.
Custetch is owned and operated by Hong Kong MemoSpace Technology Limited ("MemoSpace"). Throughout these Terms, "Custetch," "we," "us," and "our" refer to Hong Kong MemoSpace Technology Limited and its operating brand, Custetch.
If you do not agree to these Terms, please do not use our website or services.
Custetch specializes in creating personalized engraved products, including but not limited to:
Crystal engraving
Laser wood engraving
Laser leaf engraving
Acrylic engraving
Slate engraving
Personalized keepsakes
Memorial gifts
Custom photo gifts
Because every product is custom-made specifically for each customer, each order is individually manufactured after purchase.
Many of our products require customers to upload photographs, artwork, logos, text, or other design materials ("Customer Content").
By submitting Customer Content, you represent and warrant that:
You own the content or have obtained all necessary rights and permissions.
The content does not infringe any copyright, trademark, publicity right, privacy right, or other intellectual property rights.
The content does not violate any applicable laws or regulations.
The content does not contain illegal, defamatory, fraudulent, hateful, violent, sexually explicit, terrorist, or otherwise prohibited material.
You remain solely responsible for all Customer Content you submit.
To comply with applicable laws and protect our employees, partners, and customers, Custetch reserves the right to manually review all uploaded Customer Content before production.
We may refuse, suspend, or cancel any order if we reasonably believe the submitted content:
Violates copyright, trademark, or other intellectual property rights;
Uses photographs of celebrities, public figures, copyrighted characters, movies, television programs, anime, games, brands, or other protected works without authorization;
Contains pornography, nudity, sexually explicit content, or exploitation;
Promotes terrorism, extremism, violence, hate speech, or criminal activities;
Contains discriminatory, abusive, or offensive material;
Violates applicable laws or government regulations;
Creates unacceptable legal or reputational risks.
If an order is rejected due to prohibited Customer Content, Custetch may cancel the order and issue a refund at our sole discretion, less any non-recoverable payment processing fees where permitted by law.
For serious or unlawful submissions, Custetch reserves the right to preserve relevant records and cooperate with law enforcement authorities or intellectual property rights holders as required by applicable law.
Customers retain ownership of their original Customer Content.
By submitting Customer Content, you grant Custetch a limited, non-exclusive, worldwide license to use, reproduce, modify, and process the content solely for the purpose of:
Creating your customized product;
Manufacturing;
Quality inspection;
Packaging;
Shipping;
Customer support;
Warranty and after-sales service.
This license automatically terminates once the order has been completed and any reasonable retention period has expired.
Custetch does not claim ownership of your uploaded photographs or designs.
Because each product is individually handcrafted and customized, production requires additional time.
Unless otherwise stated on the product page:
Production typically begins after payment has been successfully received.
Most personalized orders are manufactured and ready for shipment within five (5) business days.
During holidays, promotional events, or periods of unusually high order volume, production may require additional time.
Production time does not include shipping transit time.
Custetch currently provides free standard shipping on eligible orders unless otherwise indicated.
Estimated delivery times are provided for reference only and are not guaranteed.
Shipping delays caused by:
Customs inspections
Weather
Carrier delays
Government actions
Force majeure
Incorrect shipping addresses provided by customers
are outside of Custetch's control.
Customers are responsible for providing accurate shipping information.
Because every product is custom-made according to customer specifications:
Customers are responsible for reviewing uploaded photographs, names, dates, spellings, and customization details before submitting an order.
Once production has begun, customization changes may no longer be possible.
Slight variations in engraving position, color, brightness, natural materials (such as wood or leaves), and handcrafted appearance are normal and do not constitute defects.
Product photographs shown on the website are representative examples and may vary slightly from the final customized product.
Due to the personalized nature of our products, customized items generally cannot be returned or exchanged unless:
The product arrives damaged;
The wrong item was delivered;
The product contains manufacturing defects;
The engraving differs materially from the approved order details because of our error.
If there is an issue with your order, please contact us within 7 days after delivery and provide photographs of the product and packaging.
If Custetch determines that the issue resulted from our error, we may, at our discretion:
Replace the product;
Repair the product;
Issue a partial refund; or
Issue a full refund.
Refunds will not be provided for customer errors such as:
Incorrect uploaded photographs;
Misspelled names provided by the customer;
Incorrect customization instructions;
Change of mind after production begins.
Custetch is committed to providing safe, high-quality products.
Where applicable, our products, materials, and manufacturing processes are designed to comply with relevant safety and regulatory requirements applicable to the markets in which they are sold, including the United States and the European Union.
Depending on the product category, this may include compliance with applicable material safety, consumer product, chemical, and environmental regulations.
We continuously work with qualified manufacturing partners and suppliers to maintain product quality and regulatory compliance.
To the fullest extent permitted by law, Custetch shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of our website or products.
Our maximum liability relating to any order shall not exceed the amount actually paid for that order.
Our website and services are provided on an "as is" and "as available" basis.
While we strive to ensure accurate product descriptions and images, we do not guarantee that all website content is free from errors, interruptions, or omissions.
Custetch shall not be responsible for delays or failures caused by circumstances beyond our reasonable control, including but not limited to:
Natural disasters
War
Terrorism
Government restrictions
Labor disputes
Supply chain disruptions
Transportation interruptions
Internet outages
Pandemic-related events

Any disputes arising from these Terms or the use of our services shall be resolved in the courts having jurisdiction in Hong Kong, unless otherwise required by applicable consumer protection laws.
